1. Acceptance of Terms
By accessing this website, placing an order, or engaging with WheelLoaders.org, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our website or purchase our machinery. These terms apply to all users of the site, including browsers, vendors, customers, and merchants.
2. Operator Responsibility & Safety
Heavy machinery, including wheel loaders, excavators, and skid steers, can be inherently dangerous if operated incorrectly. By purchasing equipment from WheelLoaders.org, the buyer acknowledges and agrees to the following:
- The buyer is solely responsible for ensuring that all operators are legally licensed, adequately trained, and familiar with the equipment's specific operating manual.
- WheelLoaders.org assumes no liability for injuries, property damage, or loss of life resulting from the misuse, improper maintenance, or unsafe operation of the equipment.
- The buyer agrees to abide by all local, state, and federal safety regulations, including OSHA standards, regarding heavy machinery operation.
3. Product Information & Pricing
We strive to display accurate technical specifications, engine details (e.g., Kubota models), load capacities, and pricing. However, errors may occasionally occur.
- We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (even after you have submitted your order).
- Prices for our equipment and attachments are subject to change without notice.
- All listed prices exclude applicable taxes, freight, and shipping costs unless otherwise specified in writing.
4. Shipping, Delivery & Title
Heavy equipment requires specialized freight logistics. All shipments are strictly arranged under standard heavy freight guidelines.
- Transfer of Liability: Risk of loss and title for items purchased pass to you upon delivery of the items to the freight carrier (FOB Shipping Point).
- Receiving Requirements: The buyer is responsible for ensuring they have the proper facility, loading docks, or heavy-duty forklift equipment to safely unload the machinery upon delivery.
- Inspection: The buyer must inspect the equipment immediately upon arrival *before* signing the Bill of Lading. Any visible transit damage must be noted on the driver's paperwork.
5. Warranties & Disclaimer
New machinery is sold with a limited manufacturer's warranty covering specific major components (e.g., engine, hydraulic pumps) for a designated period. Normal wear-and-tear items (tires, bucket teeth, filters, hoses) are excluded.
Except for the expressly stated manufacturer's warranties, WheelLoaders.org disclaims all other warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
6. Limitation of Liability
In no event shall WheelLoaders.org, our directors, officers, employees, affiliates, agents, contractors, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind.
This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, downtime costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the equipment procured using the service.
7. Governing Law
These Terms and Conditions and any separate agreements whereby we provide you equipment or services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
